DHARANA RETREATS – TERMS AND CONDITIONS
Prior to any retreat that you book with Phuket Meditation Co., Ltd.,you (the “client”) must sign up via a booking form. With this you agree to our Booking Terms & Conditions. You can find a copy of these Terms & Conditions that apply to bookable events below. In entering into an agreement with The PHUKET MEDITATION CO,. LTD. for the supply of services, each and every contracting party agrees to be bound by all the conditioned exemptions and provision herein contained.
1 Payment Terms
The Phuket Meditation Center offers Regular Retreats in Phuket. The Payment terms and conditions for the classic retreats are listed below.
1.1 Payment Terms and Deposits
In case of booking into an event hosted in Phuket (All events listed here: Phuket Retreats) the contracting party (the person who is booking) agrees to pay a booking deposit of 10% of total invoice value at the time of booking and the remaining 90% balance upon arrival at the event location during registration for the event.
1.2 Confirmation of a Booking
The Company will only accept a booking upon receipt of the booking fee. Once it is received a contract will be deemed to have been made. Until you pay the booking fee, the company shall be free to offer the date in question to other parties.
2 Cancellation, Refunds & Modifications
Here we are listing the cancellation terms for the regular retreats. We base the cancellation charges on the number of days before the arrival date of the event. You can find the details below.
2.1 Cancellation Terms
If the client wishes to cancel the contract they must advise The Company in writing as soon as possible. Any cancellation of the contract will be subject to the following cancellation charges. These cancellation terms and conditions apply to all events listed here: Phuket Retreats

2.2 Changing a Booking
It is possible for clients to modify their booking any time before the registration deadline on the arrival day. Once the deposit amount of 10% has been paid, the clients’ attendance at the event is secured and considered confirmed. The client may later change the duration of attendance, add or subtract features and/or services. The client has to inform the company about desired modifications to the booked program before the final payment is made during registration and check-in. Modifications can’t be made after the payment has been completed.
2.3 Cancellation by The Company
Phuket Meditation Co., Ltd. will always endeavor to fulfill all confirmed bookings. However, the company does reserve the right to cancel events in case of an emergency. If the company cancels a booking prior to the commencement of the event the client will be offered an alternative date or a refund.

DHARANA COACHING – TERMS AND CONDITIONS
Here you can find the Terms and Conditions for the “Dharana Coaching and Mentoring Program (DCMP)” that Tobi Warzinek (“The Coach”, “Tobi”) offers on behalf of the PHUKET MEDITATION CO., LTD. (“The Company”, “We”). Please read them carefully before booking a single, or multiple sessions. Prior to receiving sessions, the client must agree to the Terms & Conditions below. In entering into an agreement with the Company and Tobi Warzinek for the supply of services, each and every contracting party agrees to abide by all the exemptions and provisions herein contained. 1 General Terms
Tobi arranges the coaching schedule together with the client. The clients can book sessions up to 3 months in advance. With a complete purchase of Dharana Coaching & Mentoring Sessions, you confirm that you agree to all the Terms & Conditions outlined on this page.
1.1 Format of Sessions
Face to face (venue by mutual agreement), via “Viber App” or any other secure online format. Both the client as well as the coach are responsible for ensuring that they are available for consultation at agreed times. The length of each sessions is usually between 45 and 60 Minutes unless coach and client agree otherwise. The coach will recommend the frequency of sessions based on a professional assessment of the client’s requirements. This recommendation, or plan, is not binding and may be adjusted anytime.
1.3 Dates and Times of Sessions
At the beginning of the program the coach confirms dates and times of the first and subsequent sessions directly with the client in written form. We can rearrange sessions anytime in accordance with section 1.4. The coach will confirm this with the client in written form. In some cases, the coach may provide consultations on a session-by-session basis, given that no specific numbers or dates are available. This is usually the case with the first session.
1.4 Rearranging Sessions
If a client needs to rearrange an appointment, he/she should provide at least 36 hours notice. If you cancel anytime before 36 hours prior to your appointment, Tobi will reschedule the session at no additional cost. We will not give refunds to clients who haven’t used their coaching sessions and didn’t provide any cancellation notice. In some circumstances the coach may need to rearrange an appointment. When this happens he will give the client prior written notice. Such a notice doesn’t have any time limitation. We will subsequently reschedule the session at no additional cost.
Clients who purchased a ticked of either 5 or 10 sessions, can rearrange their appointments within the time-frame of 6 months after the invoice date. For the exact expiry-date, check your invoice or ask the coach. After the time-frame of 6 months, your ticket becomes invalid. As we mentioned in the paragraph above, the coach may rearrange appointments. However, you never loose sessions that have been rescheduled by the coach.
1.5 Between Sessions
The coach may give the client tasks or exercises to complete between coaching sessions. Completing these tasks will significantly speed up the client’s progress in achieving desired outcomes. However, the client isn’t obliged to complete these items of ‘homework’.
In between sessions the client may contact the coach by chat or e-mail in order to seek clarification or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment). We may also provide further coaching in between sessions at an additional cost. In such a case, however, the coach will always advise clients in advance. We won’t impose any charges without your express consent.
1.6 Early Termination
In exceptional circumstances the coach can decide to terminate the service early (e.g. illness or unavailability, bereavement or other commitments, inappropriate behavior by the client, actual or potential conflict of interest, or other reasons). In such a situation we will give the client reasonable notice of termination and refund any advance payments for outstanding sessions.
We will treat our client’s personal or business information as strictly confidential. We will not disclose any information to a third party without the client’s express prior permission. However, if the client reports abuse or threatens to harm him/herself or someone else, the confidentiality agreement becomes limited in this capacity. Furthermore, if a court orders the coach to provide information or to testify, he will do so to the extent of that the law requires.
1.8 Privacy and Security
We do our very best to secure your information (e.g. by using end-to-end encrypted services and strong password practices). This will require our clients to use certain services in order to maintain a good degree of privacy and protection. Concerning this, the coach will introduce and instruct each client at the beginning of the coaching program. Although we take adequate precaution, the use of technology is unfortunately not completely secure. There are always risks of confidentiality in the use of email, text, phone, Skype, Sync.com, Viber, FaceTime and other technologies. Thus it is also the client’s responsibility to keep passwords and information secure.
1.9 Mental Health
All coaching services and communication email or otherwise, delivered by PHUKET MEDITATION Co., LTD. and Tobi Warzinek as well as information on this website are meant to help clients identify the areas in their life that may be standing in their way. However, the DCMP is not to be confused with professional medical care. Even though it may augment traditional medical therapy, our work is meant to be done when major emotional and psychological wounds are already healing or healed.
We are not offering the coaching services as a substitute for professional mental health care or medical care. We do not intend to diagnose, treat or cure any serious mental health or medical conditions. Tobi Warzinek is not acting as a mental health counselor or a medical professional.
The clients are fully responsible for their well-being during and in between the sessions. Furthermore, they are responsible for their own choices and decisions. DCMP is not a substitute for medical/clinical counseling, psychotherapy, psychoanalysis, medical mental health care or substance abuse treatment. It should not be used in place of any form of therapy.
1.10 Coaching & Licenses
Coaching is, at present, an unregulated industry. The coach is not licensed by any internationally recognized regulator. All comments and ideas the coach offers are solely for the purpose of aiding clients in achieving their defined goals. Clients have the ability to give or withdraw their informed consent at anytime during the process.
2 Payment & Refund Terms
The coach agrees to provide the service in accordance with the terms, conditions and disclaimers listed here, in return for the fees payable by the client. The client agrees to pay fees for the service based on the terms, conditions and disclaimers listed here. If a client disagrees with any of the terms and conditions they can contact us anytime. We can discuss and see if the issues can be resolved before the first coaching session. In conclusion, a completed payment constitutes acceptance of these terms and conditions.
2.1 Payment Gateways
Clients can pay by cash, online by debit or credit card using the Paypal Gateway or by bank transfer (only local banks in Thailand). If the client requests a receipt, we will send one by e-mail unless otherwise requested.
2.2 Payment Times
As the client you need to pay the fees in advance of each coaching session or on receipt of invoice unless otherwise agreed. In case we haven’t received any payment in advance of an appointment, the coach is not obliged to provide the session. If we don’t receive the payment within 5 days of the invoice due date, the agreement becomes invalid.
If the client cancelled a session within the time-frame of 36 hours prior to the appointment, we will neither offer a refund nor reschedule the particular session (see 1.4). The client either has to make a new appointment or wait for their next appointment (in case of having purchased multiple sessions). If the client cancelled before the time-frame of 36 hours prior to their appointment, we won’t offer a refund but reschedule the session.
Given that a client has purchased single or multiple sessions and becomes unable to use them before their first appointment, we will offer a complete refund minus a processing fee (10% of the full invoice value). To be eligible, the client has to send a written cancellation note to our email at least 36 hours prior to their first session.
If the client is a no-show and doesn’t send any notifications (or call), he/she will loose the session. We won’t offer any refund and the client either has to make a new appointment or wait for their next session (in case of having purchased multiple sessions).
In case of an early termination (see 1.6) we will offer a full refund of remaining sessions minus a 15% processing fee. We will deduct the 15% fee from the total invoice value.
3 Important Additions
The coach will support the client to improve their quality of life and level of spiritual practice in order to achieve their desired outcomes. All comments and ideas the coach offers are solely for the purpose of aiding clients in achieving their defined goals. When clients follow a clear plan in a committed way they can expect to achieve remarkable results. However, the client has sole responsibility for making and executing important decisions in their life. He/She has the ability to give or withdraw their informed consent at anytime during the process. The coach has therefore no liability for any loss, damage or perceived failure incurred by any client.
3.2 Changes to the Terms and Conditions
Any changes to these terms and conditions will be effective only if coach and client mutually agree. The coach may change any of these terms or conditions, including the session fees. In this case he will notify the client of the change(s) in written form. If the client consequentially no longer wishes to proceed with further coaching sessions, he/she may withdraw from the service immediately by giving notice in writing by email or letter. He/she will be entitled to a full refund of any fees paid in advance for coaching sessions not yet provided.
3.3 Governing Law
This contract is governed by the law of Thailand whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.
DHARANA SPECIAL EVENTS
Here you can find the Terms and Conditions for all our Events such as Workshops, Seminars, One-Day Retreats and Special Classes. Our Classic Retreats and our Free Classes are not addressed in this section. Please read them carefully before you book or make a reservation. 1 Payment Terms
1.1 Free Events
If the event is free or donation-based, we do not collect payments in advance. The registration form will only help us to know how many people will come. While it is helpful for us to receive your registration, it is not a prerequisite to sign up. Furthermore it helps us to know how to prepare the location. After the event you can make a donation.
1.2 Chargeable Online & Live Events
In case of an online event, you will only receive the invitation details if you have payed in advance. It is not possible to participate if a payment has not been made. Payments may either be collected through an online gateway or during the registration at the location. Payments will be collected in full. For changes in the registration, the organizer retains the right to charge an administration fee. For changes/cancellations an administration charge of 10% of the registration fee is applicable. It is possible to change the participant information to allow a replacement to attend the event in your place up-to 24 hours prior to the event start. Switching tickets to different event dates or cities are not permitted.
1.3 Cancellations & Refunds
In case of cancellation longer than 3 months before the event starts, no costs will be charged.
If you cancel within 3 months of the event but longer than 1 month before the event you will be charged 20% of the registration fee as cancellation fee.
In case of cancellation within 1 months of the event but longer than 2 weeks before the event you will be charged 70% of the registration fee as cancellation fee.
If you cancel within 2 weeks before the event 100% of the registration fee will be charged.
Cancellation needs to be done in writing by e-mail to the organizers. The date of cancellation is determined by the date of the e-mail.
In case of insufficient number of registrations the organizer retains the right to cancel or postpone the event. In such a case, you will naturally receive a full refund.
2 Waiver & Consent
2.1 Consent to the Use of Media
Registrations and attendance at, or participation in Phuket Meditation Center’s events constitutes an agreement by the registrant to Phuket Meditation Company Limited’s use and distribution (both now and in the future) of the registrant or attendee’s image or voice in photographs, videotapes, electronic reproductions and audiotapes. Please let us know at the time of registration if you would like to withdraw your agreement so we can find a way to exclude you from audio or video material.
2.2 Liability Waiver
In consideration of being allowed to register for, and participate in, the events I hereby warrant and represent that I am age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue Phuket Meditation Company Limited or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that I may hereafter suffer or sustain before during or after the Event unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Phuket Meditation Company Limited. This Waiver and Releases is specifically binding upon my heirs and assigns and is knowingly given.
